TERMS & CONDITIONS

Please read these Terms & Conditions carefully as they incorporate the basis upon which all reservations are accepted by Near City Rentals Ltd (NCR). Making a reservation automatically accepts all the Terms & Conditions outlined hereunder. Near City Rentals Ltd reserve the right to change and/or modify any of these Terms & Conditions and time without notice. Such changes will become effective immediately. Please Check these Terms & Conditions periodically for any changes.

Effective date of these Terms & Conditions is January 2016.

ADVANCED RESERVATIONS

Near City Rentals will not guarantee or confirm a reservation made more than fifty-one (51) weeks or 358-days prior to arrival. Requests and quotes beyond this period may be possible; however no rates and availability will be guaranteed and confirmed. Near City Rentals reserves the right to cancel or amend (with reasonable notice) any reservations made beyond this period.

PARKING

Parking is complimentary in some locations so please refer to your rental description prior to booking your rental.

PAYMENTS

Rates quoted are valid for 48 hours

A deposit of 50% of the total value of your stay is required to confirm your booking.

The final balance is due 28 prior to arrival.

Bookings received within 8 weeks of the date of arrival must be paid in full at time of booking.

A reminder of your final fee will be sent via email 28 days prior to your arrival.

Non-payment of your final fee by 14 days or fewer prior to your arrival will result in the cancellation of your booking. Your Booking Deposit is non-refundable and our cancellation policy does not apply.

Once a completed Booking Form and/or a request to book from the guest has been received, NCR will email you to confirm your payment method and/or send you our bank details.

RATES

All rates are quoted in Euro (€) and include 9% value added tax (VAT). Rates within reservations that have a valid confirmation by Near City Rentals will be honoured. Rates that have been quoted are not confirmed until a valid confirmation email has been received from Near City Rentals and therefore subject to change. Near City Rentals reserve the right to amend rates that have been confirmed at incorrect rates due to human or distribution errors.

All rates quoted are subject to availability and alteration and may be subject to a minimum night stay.

PHOTO IDENTIFICATION

Valid photo identification (ID) matching the name of the Credit Card provided must be presented at time of booking. NCR will accept photographs/scanned copies of the Credit Card & a valid Driver’s License or Passport. This ID may be copied and securely stored on record once we have verified who you are and your authority to use your Credit Card. This is purely as an anti-fraud measure. As per our privacy policy, any personal information contained on the collected identification will not be shared; will be securely stored and carefully disposed of at the end of its usefulness.

SECURITY DEPOSITS FOR DAMAGE, EXTRAS AND CLEANING

NCR requires payment of a Security Deposit/Breakages Bond on Check-In at all our rentals. The Security Deposit must be paid by the first guest to arrive at the rental to Check in with the House Manager. The House Manager is unable to return to the property to collect the deposit at a later stage. The amount is €500 and can be paid by the following methods;

Cash on arrival. This may be paid in your local currency if you wish, which will save on exchange rates, and must be paid by the first guest on arrival to the rental.

Credit Card. No fees apply.

Please Note; for payments via credit card, the actual deposit is taken from your account and then refunded back onto your card after the rental has been inspected on your day of departure. Refunds normally appear back into your account in 24-48 hours but can take up to 7 working days. NCR is not liable for delays in refunds via Credit Card.

Please Also Note, if you plan to Check Out any earlier than 6am on day of departure, your Security Deposit/Breakages Bond must be paid by credit card.

Security Deposits/Breakages Bond will berefunded on departure provided;

No damage to the property and/or its contents has occurred

No undue disturbance to neighbours/neighbouring properties has occurred

If damage or disturbance to other guests has occurred, the cost to NCR of the damage or disturbance that has occurred will be retained from the Security Deposit and the remainder returned to the Guest.

If this cost exceeds the value of the Deposit, or no Security Deposit has been taken, Guest agrees to indemnify NCR for the damage, additional cleaning costs or other charges and agrees to pay all costs of recovery against guest including legal costs, court costs and other expenses.

Please Note: Near City Rentals reserves the right to charge the “Lead Guest” for any damage caused by the guest or any of the guest’s party. The “Lead Guest” is the person under whose name the reservation is made with Near City Rentals. A full inventory check of the property is carried out before the guests’ arrival and after the guests have departed. Any damage to the property or missing/damaged contents will be charged to the Lead Guest.

FAILURE TO PAY

In the event that a guest fails to pay immediately, upon demand, any amount owing to Near City Rentals (including but not limited to Security Deposit/Breakages Bond, additional charges agreed at time of booking), Near City Rentals reserves the right to deny access to the guest and ask that they vacate the premises.

CANCELLATIONS

We operate a strict Cancellation Policy. If a cancellation occurs, we will only refund payments if/when we manage to re-sell your cancelled dates in the same rental. All cancellations incur a 10% Admin Fee. This fee is calculated as 10% of the overall value of your entire stay.

If we re-sell all your nights, we will issue a full refund of monies paid, less a 10% Admin Fee.

If we only re-sell some of your nights then we will only refund the value of the nights re-sold, less the 10% Admin Fee. The value of the nights sold is calculated using the average nightly rate of your original booking.

We do not operate a cancellation insurance scheme but we strongly recommend that all guests take out full cover.

DATE CHANGES

Should you need to alter the original dates booked, NCR will endeavour to accommodate your booking on your new dates, subject to availability, however we cannot guarantee that we will be able to do so and it accepts no liability for any loss, damage or additional expense that may be incurred in th circumstance. Rates quoted may also be subject to change.

CHECK IN REQUIREMENTS

Standard Check-In times are 2pm/3pm and may differ from property to property. If you request an earlier Check-In NCR will only be able to confirm or deny your request 48 hours prior to your arrival date, as we may have guests checking out the same day as you arrive. If you wish to explore our wonderful city whilst your rental is being cleaned, we can recommend things to do whilst you wait for your rental to be guest ready. You will also be able to leave your luggage either at the rental or at another secure location. (Please note; the secure storage location for luggage is not easily accessible if you are travelling by public bus). Your luggage will be collected and delivered to your rental from the secure location. 48 hours prior to your arrival we will confirm your check-in time and/or the luggage drop off point.

LATE CHECK-IN FEE

Please note as all our properties are self-catering we do not have a Reception Desk (e.g. a staff member on duty all day at your rental). Our House Manager will arrive 30 minutes prior to your stated Check-In time. We are flexible with a ONE HOUR DELAY in your Check-In time but thereafter there will be a late Check-In fee applied of €50 per hour (plus any applicable fees). It is imperative that you contact your House Manager on your day of arrival, prior to arriving at the property.

CHECK OUT REQUIREMENTS

Standard Check-Out time is 11am/12pm.Please refer to rental description before you book to confirm the Check-Out time for your property. If a late Check-Out is required, NCR will only be able to confirm or deny this request 24 hours prior to your departure.

MINIMUM STAY

A minimum length of stay may apply during high demand/special event periods (in particular Christmas, New Year, St. Patrick’s Day) as determined by NCR Ltd.

OCCUPANTS

The rate is for the exclusive use of the rental regardless of the number of occupants (i.e. from 1 person to the maximum occupancy stated for that rental). Only the persons notified to NCR prior to arrival may occupy the property. Guests may not re-let/sublet the property to any other third party without NCR’s prior written approval. The number of persons permitted to occupy the property is limited to the number of beds available and this limit may not be exceeded without NCR’s prior written approval. NCR reserves the right to refuse admittance to the property if this condition is NOT STRICTLY complied with.

RULES OF ACCOMMODATION

As a guest in NCR Ltd, you are required to respect the Conditions of Use of the property. NCR aims to ensure that you and your fellow guests have a safe and enjoyable stay, and that our neighbours and community in general are not disturbed. Noise pollution will not be tolerated and PARTIES OF ANY KIND ARE NOT ALLOWED. Access to the outdoor areas are restricted after 10pm. Most of our properties are located in quiet, residential areas and we ask that you are considerate and respectful of the surrounding neighbours. Please familiarise yourself with our House Rules in order to avoid any problems during your stay.

HOUSEKEEPING OF RENTALS

All rentals are cleaned prior to guest arrival with the following linen and towels provided.

Double Bed has 1 x fitted sheet, 1 x duvet & 4 pillows

Single Bed has 1 x fitted sheet, 1 x duvet & 2 pillows

Double Sofa Beds have 1 x fitted sheet, 1 x duvet & 4 pillows

Extra Single Fold-Down Beds have 1 x fitted sheet, 1 x duvet & 2 pillows

Cots (Cribs) have a fitted sheet, kids’ duvet & pillow

1 x bath towel & 1 x face cloth per guest

2 x hand towels per bathroom

2 x bath mats

2-4 tea towels (depending on property size)

As our rentals are Self-Catering Holiday Rentals we do not offer a Housekeeping Service or linen changes for the duration of your stay. We can of course provide cleaning services and/or linen on request, at the Guests’ expense. Please refer to Reservations.

CONDITIONS OF USE OF PROPERTIES

Standard occupancy for each property is shown on our website. Guests should check maximum occupancy at the time of booking

Only the number of guests, named on the booking form or via email request prior to your arrival may stay in the property during the reserved dates.

A surcharge of €100 (processing fees apply) per extra person per night may apply and NCR may insist on payment of such a surcharge before allowing guests to access to the property

Prices are inclusive of tax, utilities, all linen, towels, internet usage (fare usage applies)

Rentals are to be vacated at the agreed time and left in a neat and tidy condition

All rubbish/trash is to be bagged and placed in waste bin/trash area. Please refer to your House Manager.

Pots, pans, crockery, cutlery, utensils are to be washed or placed in dish washer and switched on prior to your departure

An additional minimum cleaning charge of €250 (processing fees apply) OR MORE may be applied by NCR in the event that property requires additional cleaning or has to be withdrawn from use due to damage or some other reason arising from guests’ misuse.

EVICTION OF A GUEST

If NCR receives serious complaints, disputes arise or NCR reasonably believes the guest is in breach of these Terms & Conditions, NCR reserves the right to terminate the guest’s stay without notice.

Excessive noise

Intoxication and/or unsavoury behaviour

Any behaviour posing a safety threat to others

Any incident for which the police need to be called onto the premises

Wilful damage to NCR property

Physical or verbal assault towards NCR representatives, neighbours, residents or other guests

Overcrowding - when the number of persons in the rental exceeds the capacity

Ignoring advice to reduce excessive noise (music or other noise)

FACILITIES / SERVICES

All properties are fully furnished and include a kitchen fully equipped with appliances, cutlery, crockery, and kitchen utensils. No food is provided except for an initial welcome pack. No items may be removed from the property.

PHOTOGRAPHS AND DESCRIPTIONS

Whilst care is taken to ensure that the photos and description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion removed from service. If any feature or facility is essential to you in choosing a particular property, we highly recommend emailing Near City Rentals Reservations who will assist your decision making process and if that feature or facility will be available during your stay. Descriptions are based on information available at the time of publishing and may vary or change at any time. Maps and location photographs are shown for general information only and highlight places in surrounding areas. Actual rentals occupied may vary in decor and inclusions from those shown in photographs.

NO-SMOKING

Please note that all our rentals are strictly non-smoking, however there are designated outdoor smoking areas available. Please refer to your check-in manager upon check-in and/or the guest notices within your rental. A minimum charge/fine of €250 (processing fees apply) or more may applied to clean and deodorize your rental in the event that smoking has occurred inside the property.

ACCOMMODATION CHANGES

In exceptional circumstances NCR may find it necessary to cancel your booking or may need to provide you with alternative accommodation to an equivalent standard. If this is not possible or accepted, NCR will refund any sum the guest has paid to NCR which shall constitute full and final settlement of any liability NCR may have to the guest as a result of such cancellation. NCR reserves the right to cancel the booking if;

The property, or any part of it is closed due to circumstances beyond its control

NCR becomes insolvent or enters into liquidation or receivership

It prejudices the reputation or causes/might cause, in NCR’s opinion, damage to adjoining properties

In any of these circumstances, NCR will refund any payments made in advance but will have no further liability to the guest. We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled or NCR is unable to perform its contractual obligations as a result of events beyond its reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions.

ACCESS

NCR, or its authorised personnel, may at any time access the property for the purpose of inspection of the property, and to carry out repair or maintenance work.

INSURANCE

You will ensure that nothing is done which may jeopardise our insurance policy or any part of it in respect of the property and its contents.

COMPLAINTS

NCR warrants to use all reasonable efforts to ensure that your chosen accommodation is properly arranged and is of a reasonable standard. You must immediately notify NCR of any complaint, and in any event no later than 6 hours after your arrival. All complaints must be sent by email to bookings@nearcityrentals.com. It is up to the lead guest prior to booking the rental to research the area that the rental is located in and that the rental specifications as set out on our website are suitable for you and your guests for the duration of your stay. We will not refund a guests booking fee or relocate the booking to an alternative rental due to the location of your rental. In the case of a dispute under no circumstances shall NCR’s liability to the Guest exceed the amount paid to it for the rental period.

PETS

Please enquire directly with NCR regarding any pets in any of our properties. Guide dogs are permitted with prior agreement.

DAMAGE

NCR will not be responsible for any theft of, or loss or damage to your goods or personal belongings kept at the accommodation. NCR strongly recommends our guests to take out travel insurance to cover any such losses. The Guest is also responsible for taking all reasonable care of the rental and its contents. The rental and all equipment, utensils, furniture etc. must be left clean and tidy at the end of your stay, or charges may be applied.

Except in the case of normal wear and tear you are responsible for any damage to the property or its contents during your stay which has occurred due to the negligence, wilful default or irresponsible behaviour on the part of yourself or those occupying the property or their guests. Any damage must be reported to us by you, without delay.

FAIR USE

You and your party agree to be considerate tenants and to take good care of the property(s) and to leave it/them in a clean and tidy condition at the end of the rental period. You and your party also agree not to act in any way which would cause disturbance to those residents in neighbouring properties

RIGHT OF ENTRY
In the event that the Near City Rentals has a legitimate cause for concern or if the guest has not been seen nor been able to be contacted over a period of time, the suite may be entered by an NCR Ltd representative to ensure the safety and comfort of all guests is in order.

USE OF COMPANY PROPERTY

(a) The use of any NCR Property for the purpose of conducting business, of any kind, is expressly forbidden, except where written permission from NCR has been granted.

(b) NCR grants the use of its property solely for appropriate, legal, personal use.

(c) NCR expressly forbids entry to its property to any persons other than those listed under the relevant booking.

(d) NCR and Guest agree that no tenancy rights accrue as a result of the usage of property

NCR reserves the right to terminate without notice any reservation/booking that NCR deems to be in breach of its Terms and Conditions, irrespective of whether the Lead Guest of this reservation, or any member of the group associated with the Lead Guest, has checked in.

LIABILITY

Unless negligence by NCR is established by an independent body, appointed in agreement with NCR, NCR will not be held liable for injury to person, loss of, or damage to any property of any guest or person staying/visiting the properties and or its general facilities and area. Vehicles parked are done so at the risk of the guest.Once a booking has been accepted by NCR, a contract exists between Guest and NCR. Accepting a reservation with NCR indicates acceptance of these Terms and Conditions. This contract shall be governed by Irish law in every particular including formation and interpretation and shall be deemed to have been made in Ireland. Amendments to NCR Terms and Conditions may be subject to change at any time and without notice.

These terms and conditions shall be interpreted under Irish law and shall be subject to the jurisdiction of the Irish Courts.

DISCLAIMER

The information contained within this site is of a condensed and general information nature only and can change from time to time. It should not, by itself, be relied upon in determining legal rights or other decisions. Readers / users are advised to verify, by direct and live contact with Near City Rentals, any information on which they may wish to rely.

PRIVACY POLICY

Your private information will not be disclosed to third parties without your expressed permission. We will not disclose financial information unless disclosure is required by law or a court order, or unless disclosure is required to address an issue implicated by the financial transaction.

SECURITY

Most rentals have intruder alarms which must be activated for the duration of your stay. Guests are advised to take all reasonable precautions to lock the rentals at night or if absent from the rental during the day. CCTV is in operation on the exterior of the properties. This is to ensure the safety of the guests and property but not to monitor guests’ activities. All rentals have Guest Safes and we strongly advise that these are used to store your valuable possessions.

A minimum of 7 days' notice is required for extra beds or travel cots (cribs). Extra beds/cots cannot be set up on your day of arrival. Payment for extra beds must be paid in advance of your arrival.

TECHNICAL ASSISTANCE

As our House Managers have limited technical knowledge, we are unable to offer technical support for personal devices to connect to the entertainment system within your rental. With this in mind, if you wish to show a video/slideshow whilst at the rental, may we suggest that you upload your video/slideshow onto YouTube prior to arrival. All our rentals have a Smart TV and has the Youtube App installed.

AIRPORT TRANSFERS

NCR can provide a variety of Airport Transfer options via our transfer partner. Please contact us directly for information and pricing.

GROCERY DELIVERY

Groceries can be delivered to most rentals on your day of arrival if required. Please contact us directly for details.

WEBSITE USE & CONTENT

While every effort has been made to ensure the accuracy of all information, NCR does not accept liability for any errors or omissions and reserves the right to change information and descriptions of listed accommodation and products without notice.

This website is created and maintained in Ireland. Care has been taken to ensure the information provided in this website is accurate and complies with Irish laws & regulations. No liability will be accepted for omissions or errors.

Due to hosting maintenance and unscheduled repairs, service is not guaranteed as uninterrupted. NCR will not be held liable for any losses due to such downtime. Unauthorised changes to this site by third parties will also be under no liability. Guests enter site at own risk.

NCR offers no guarantee any content downloaded from this site will not have a harmful effect on your computer (such as loss of data etc.,). Although every care has been taken to prevent this from happening, NCR always recommends running a virus scan on any content downloaded from the Internet.

FORCE MAJEURE

Guests and hotel representatives of Near City Rentals are allowed partial impossibility in an agreement, where the performance of the agreement by either party is subject to acts of God, war, terrorism, government regulations, national disaster, strikes, civil disorder or curtailment of transportation facilities beyond the control of the parties making it inadvisable, illegal, or impossible to fulfil some or all of the agreement. Any agreements, contracts, quotes and reservations may be terminated without penalty for any one or more of such reasons by written notice from one party to the other.

LIMIT OF LIABILITY

We do our best to ensure your reservation arrangements are satisfactory, however Near City Rentals not accept any liability whatsoever for any injury damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control including, but not limited to, war, civil disturbance, terrorism, fire, floods, acts of God, acts of Government or of any other authorities, accident to or failure of machinery or equipment, maintenance requirements or industrial action.
